1. Acceptance of terms

By accessing or using Mental Fortitude, you agree to these Terms of Service. If you are using the platform on behalf of an organization, you represent that you have authority to bind that organization to these terms.

2. Description of service

Mental Fortitude is a B2B SaaS platform that provides workplace mental wellness tools including clinical-grade assessments, educational content, partner feedback, therapist recommendations, and employer reporting features. The service is sold to organizations on an annual per-seat subscription basis.

3. Account responsibilities

• Organization owners are responsible for managing employee access, maintaining accurate billing information, and ensuring use complies with these terms and applicable law.
• Employees are responsible for safeguarding their login credentials and providing accurate information during assessments.
• You must notify us immediately of any unauthorized access to your account.

4. Acceptable use

You agree not to:

• Use the platform for any unlawful purpose or to harass, abuse, or harm others.
• Attempt to access data belonging to other users or organizations.
• Reverse engineer, scrape, or interfere with platform security or infrastructure.
• Share login credentials or assessment results in ways that violate employee confidentiality.

5. Health data disclaimer

Mental Fortitude provides wellness assessments and educational resources. It is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of a qualified health provider with questions about a medical condition. If you are experiencing a mental health emergency, contact emergency services or a crisis hotline immediately.

6. Subscription and billing

Subscriptions are billed annually in USD through Stripe at the published per-seat rate. By subscribing, you authorize recurring charges for each billing period until canceled. Seat counts, upgrades, and refunds are governed by our Refund Policy.

7. Termination

Either party may terminate a subscription at the end of the current billing term. We may suspend or terminate access immediately for violations of these terms, non-payment, or conduct that threatens platform security or other users. Upon termination, access to the platform ceases and data handling follows our Privacy Policy.

8. Limitation of liability

To the maximum extent permitted by law, Mental Fortitude and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform. Our total liability for any claim shall not exceed the amount paid by your organization in the twelve months preceding the claim.

9. Governing law

These terms are governed by the laws of the United States and the State of Delaware, without regard to conflict of law principles. Disputes shall be resolved in the courts of competent jurisdiction in the United States.
